VAWA

The Violence Against Women Act (or VAWA), though inaptly named, applies to both male and female victims of battery or extreme cruelty at the hands of 1) a U.S. citizen spouse or former spouse; 2) a U.S. citizen parent; 3) a U.S. citizen son or daughter; 4) a lawful permanent resident (LPR) spouse or former spouse; or 5) a LPR parent.

​The beauty of VAWA is that it allows you to self-petition and adjust status (i.e., obtain your green card) without some of the normal bars interfering with that process. Although the circumstances necessary to be eligible may not be ideal, VAWA as a vehicle to permanent residency and naturalization is beneficial to victims of abuse and battery. Importantly, you will not need your abuser's consent to apply, and they will not be informed of your application unless you tell them. If you are still living with your abuser, you can use a safe mailing address (e.g., your attorney's address) so that your abuser will not have access to your immigration documents.
