Here's a list of frequently asked questions on immigration issues. The answers below are for informational purposes only and do not replace legal advice.

Why contact an immigration attorney when my friend did all the forms himself and got his green card?

Cases can vary dramatically based on very similar facts. While a non-immigration lawyer my find your facts similar to your friend's facts, an immigration lawyer might find big distinctions between your case and your friend's. Using a notary, or doing it yourself, might work out or you could be in a much worse situation. While you can represent yourself in immigration proceedings, often you will find yourself swamped. Proceed with caution. Remember, you can consult with an immigration attorney without retaining one.

I entered the United States unlawfully. What do I do now?

The answer will depend highly on your individual circumstances. However, just because you entered the United States unlawfully does not mean you will not be able to obtain a green card and eventually naturalize. Consult with us to determine your next steps.

Am I eligible for a Commercial Driver's License?

Recent changes in the law mean that even if you were previously eligible for a CDL in Pennsylvania you may no longer be eligible. Even if you find yourself no longer eligible under current regulations, there may be methods of regaining your eligibility. Speak with us to determine paths to your future eligibility.

Someone told me that I need to register for the draft or the Selective Service. Do I?

That depends on different factors. Generally, all males from 18-25 years of age must register even if you are "undocumented." Exceptions exist for those admitted through a non-immigrant visa. It is legal where I live to buy medical and/or recreational marijuana for my personal use. Can I sign up and buy?

Personal use of marijuana remains a federal crime. Immigration laws are federal. Thus, any participation in any program that is considered unlawful federally can have enormously negative impacts on your immigration case. That being said, there are exceptions and highly technical caveats that may apply to your case if you have been convicted or face a conviction for narcotics. It is highly important that you speak to an attorney knowledgeable about the intersection of criminal and immigration law as soon as you are charged with any such crime or believe you are at risk of such charges.

I have a landlord. Can they ask me about my immigration status?

A landlord cannot lawfully discriminate against you based on your national origin, sex, religion, race, color, familial status, or disability. This is so regardless of your immigration status. If you believe your rights have been violated, you can report it to HUD.

I like to drink and drive. Will this be an issue for my immigration case?

Convictions, and even charges, for driving under the influence are problematic for immigration cases. You might ruin your ability to obtain certain forms of relief or end up in immigration detention. Seek help before you have an incident with the police. If you face charges, or you have been convicted, contact us so we can determine the right course of action for your case.

I enjoy driving. Can I obtain a Pennsylvania driver's license?

Depends. The Commonwealth of Pennsylvania has certain requirements of identification, residency, and lawful presence for non-United States citizens. Here's the chart. If you have questions, you can go to your local driver license center or contact us.

I like flashy, fast cars with loud stereos. Is this a problem for my immigration case?

Not necessarily but beware of what happens when you put the quarter in the juke box. Law enforcement might be enticed by your choice of vehicle to stop you, rightly or wrongly, and say hello. Until you are comfortable with your immigration status, consider that ants are drawn to sugar.
