Abuse and VAWA

Spouses, parents, and children of U.S. citizens and lawful permanent residents have a unique pathway to become a lawful permanent resident if your relative has abused and/or battered you. Even applicants who may have other immigration problems such as an unlawful entry, may still seek to pursue a VAWA pathway with success.

Obtaining a green card through this process does not require that you have a restraining order against your significant other or even that a police report has been filed. Navigating the process can be challenging. If you are unsure about whether you qualify, seek out legal advice. For instance, many people do not realize that they may qualify for VAWA benefits even though they are male or are already divorced. Further, there is no requirement that you inform your significant other that you have applied for this benefit and USCIS may not release information to them about your case.
